PRINCETON — A Virginia man is suing a Princeton auto dealership, alleging breach of express warranty.

Dominick L. Briley of Tazewell County, Virginia, filed a complaint March 19 in Mercer Circuit Court against Ramey Motors Inc., alleging violation of the West Virginia Consumer Credit Protection Act.

According to the complaint, in 2017, Briley purchased a used 2012 Hyundai Sonata from Ramey Motors at a retail price of $12,156 with the balance due on delivery in the amount of $14,985.67. Shortly after, Briley says, he discovered that the vehicle suffered frame damage that was announced at the auction where Ramey Motors purchased the vehicle.

The plaintiff says he has been annoyed, harassed, upset, harangued and distressed. He alleges Ramey Motors Inc. responsible because the defendant allegedly misrepresented the condition of the vehicle by falsely expressing that it has no previous damage.

Briley seeks trial by jury, actual and statutory damages, elimination of the alleged debt, attorney fees, court costs and all other appropriate and equitable relief. He is represented by attorney W. Blake Belcher of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford PLLC in Bluefield.

Mercer Circuit Court case number 18-C-78
