Putnam nursing facility alleges guardian, conservator owe nearly $40,000

WINFIELD — A Hurricane nursing facility is suing a legal guardian and conservator, alleging breach of fiduciary duty in failing to pay nearly $40,000.

Teays Valley Center filed a complaint March 22 in Putnam Circuit Court against Brett W. Long, individually and as legal guardian and conservator of Dorothy Long, alleging the conservator failed to fulfill his contractual obligations.

According to the complaint, between March 1-June 15, 2017, Brett Long's mother, Dorothy Long, was a resident Teays Valley Center. As of July 1, 2017, the suit says, the outstanding balance of $39,870.79 remains unpaid. 

The plaintiff alleges Brett W. Long has failed to pay for the center's services to Dorothy Long and failed to apply to Medicaid for benefits on her behalf.

Teays Valley Center seeks trial by jury, judgment of $39,870.79, plus collection costs, attorney fees and late fees from July 1, 2017.  It is represented by attorneys Robert L. Greer and Jonathan W. Fischer of Greer Law Offices PLLC in Clarksburg.
