BECKLEY — A Raleigh County couple is suing a Ghent resort and a driver, alleging negligent driving and negligence entrustment.
David E. Chinn, Jr. and Cyndie Chinn filed a complaint in Raleigh Circuit Court against Jody Allen Robertson, Janelle Rene Brogan, Thomas Moore and Skyline Resort LLC, alleging the defendants operated, maintained and entrusted the vehicle contrary to and in violation of West Virginia law.
According to the complaint, on Sept. 24, 2017, David E. Chinn, Jr. suffered serious and permanent injuries when his vehicle was struck by Robertson as she was driving a 2014 Chevrolet Silverado owned by Brogan. The lawsuit states Brogan was authorized to operate the vehicle by Moore, Brogan's father.
During the incident, the suit says, Robertson was intoxicated with alcohol while on Skyline's premises before leaving and proceeding to operate the vehicle. As a result, Cyndie Chinn alleges she had suffered the loss of consortium of her husband.
The suit says Skyline breached its duty by overserving Robertson and not ending all alcohol service by 3 a.m.
The plaintiffs allege Robertson failed her duty to the public not to operate a motor vehicle in an intoxicated state or in a manner that was negligent.
The Chinns seek trial by jury, punitive damages, expenses incurred, attorney fees and all other relief the court deems proper. They are represented by attorney Brandon S. Steele of Beckley.
