RIPLEY — A Jackson County woman is suing AFLAC and an agent, alleging bad faith and breach of contract.
Ivy Grace Williams filed a complaint March 20 in Jackson Circuit Court against Zachary Dunham and American Life Assurance Company (AFLAC) of Columbus, alleging they violated West Virginia law. .
According to the complaint, AFLAC's actions have caused Williams to sustain extreme aggravation, emotional stress, pain and suffering, mental anguish, embarrassment, economic loss, inconvenience, attorney fees, court costs and expenses. She says her difficulties result from AFLAC's deliberate and bad faith actions in denying her of coverage under Williams' short-term disability and hospital confinement indemnity insurance policies in relation to her pregnancy.
The plaintiff alleges Dunham and American Life Assurance Company of Columbus failed to fully and properly investigate, evaluate and resolve Williams' claim and deprived her the insurance contract's benefits.
Williams seeks trial by jury, compensatory, general and special damages, punitive damages, interest, court costs, attorney fees and all further just relief. She is represented by attorney Troy N. Giatras of The Giatras Law Firm PLLC in Charleston.
