Wellsburg widower alleges erroneous death certificate, autopsy

CHARLESTON — A widower is suing the state medical examiner's office and a physician, alleging negligence in the reporting of his wife's death.

Dr. Patsy P. Cipoletti Jr. of Wellsburg, administrator of the estate of June Cipoletti, filed a complaint March 21 in Kanawha Circuit Court against the Office of the West Virginia State Medical Examiner and Dr. Allen R. Mock, alleging they negligently prepared an erroneous death certificate and autopsy report.

According to the complaint, as a result of the defendants negligent acts, June Cipoletti's family, distributees and beneficiaries suffered great mental pain and anguish. The plaintiff alleges the defendants negligently filed and signed the decedent's death certificate by falsely concluding acute and chronic alcohol intoxication contributed to her death.

Patsy Cipoletti seeks trial by jury, correction of the erroneous death certificate, compensatory and punitive damages, pre- and post-judgment interest and all other just relief. He is represented by attorney Richard D. Lindsay of Tabor Lindsay & Associates in Charleston.
