Caterpillar Financial alleges debtor, guarantor owe $25,000

BECKLEY — Caterpillar Financial is suing a Beaver debtor and guarantor, alleging breach of contract and a guaranty agreement.

Caterpillar Financial Services Corporation filed a complaint in Raleigh Circuit Court against Black & White Natural Resources LLC, Thomas Trucking LLC and Joseph Thomas alleging they failed to perform their contractual obligations and owe more than $25,000.

According to the complaint, on Oct. 28, 2016, Carter Machinery assigned the defendants contract for a financed Caterpillar 525B Skidder to Caterpillar Financial in the amount of $32,650. As of Feb. 7, 2018, the suit says, the amount due under the contract is $25,251.68, excluding costs, attorney fees, late fees and additional interest. 

The plaintiff alleges the defendants have defaulted on the contract by failing to make the required payment and have refused to return the Skidder.

Caterpillar Financial Services seeks trial by jury, judgment in the amount of $25,251.68, with interest, award for the possession of the Skidder, court costs, attorney fees and all other appropriate relief.
