Employee accuses Save-A-Lot grocery operator of wrongful termination

NEW MARTINSVILLE — A former employee is suing a Save-A-Lot grocery store operator, alleging discrimination, retaliation and wrongful termination.

Jason L. Day of New Martinsville filed a complaint March 28 in Wetzel Circuit Court against Legacy Investments Inc., alleging the Save-A-Lot grocery store operator violated the West Virginia Code.

According to the complaint, in February 2016, Day was injured while working for the defendant's Save-A-Lot grocery store in New Martinsville. In April 2016, Days says, he reported his injury to his supervisor and requested to file for workers' compensation claim. In doing so, the suit says, Day was unlawfully fired, causing him damages for lost wages and employment benefits. 

The plaintiff alleges Legacy Investments discriminated and retaliated against him by terminating his employment for attempting to receive workers' compensation benefits.

Day seeks trial by jury, compensatory damages, reasonable expenses, attorney fees and all other just and proper relief. He is represented by attorney Adam E. Barney of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
