Customer alleges Nissan sold defective vehicle

PINEVILLE — A Wyoming County man is suing Nissan, alleging breach of express and implied warranties in selling a defective vehicle.

Paul A. Brown filed a complaint March 29 in Wyoming Circuit Court against Nissan North America Inc., alleging failure to to comply with the Consumer Protection New Motor Vehicle Warranties Act of West Virginia.

According to the complaint, on Dec. 27, 2016, Brown purchased a Nissan Frontier Truck from a Nissan dealer, Lewis Automotive Group in Beckley, for $28,281, After purchase, Brown says he experienced non-conformities with the the truck, causing the plaintiff to bring the truck in for repairs at least three times. Such non-conformities, the suit says, caused Brown to suffer annoyance, inconvenience and loss of use of the vehicle. 

The plaintiff alleges Nissan North America has failed to perform repair works in a good and workmanlike manner to conform the vehicle with its warranties.

Brown seeks trial by jury, revocation of acceptance, refund of the purchase price of $26,657.31, damages of not less than $15,000, court costs and attorney fees. He is represented by attorney David G. Thompson of Pineville.
