Customer alleges Ford dealer sold defective vehicle

RIPLEY — A Jackson Count man is suing Ford and a Ford dealer, alleging breach of express and implied warranties.

Jerry Southall filed a complaint April 2 in Jackson Circuit Court against Ford Motor Company and Moses Ford, alleging violation of the West Virginia Code.

According to the complaint, on May 27, 2016, Southall purchased a new 2015 Ford F350 from Moses Ford. After purchase, the suit says, Southall experienced numerous non-conformities with the F350, substantially impairing its use, value and safety. These problems included a shaking steering wheel and a rusted undercarriage. 

The plaintiff alleges Ford Motor Company and Moses Ford failed to properly repair or correct the defects to comply the vehicle with its warranties.

Southall seeks trial by jury, replacement of the motor vehicle, refund of the purchase price and other reasonable expenses, special damages, court costs, plus all other proper and just relief. He is represented by attorney Joel Baker of Baker & Honaker PLLC in Ripley.
