Motor vehicle driver allegedly killed cyclist

CHARLESTON — A family member is suing a South Charleston motorist, alleging insufficient measures were taken to prevent the injuries and death of a cyclist.

Shawnna Paxton, as personal representative of the estate of Shawnee Nicole Paxton, filed a complaint in Kanawha Circuit Court against David Lee Workman, alleging the motor vehicle driver failed to maintain proper control of his vehicle.

According to the complaint, on July 22, 2017, Shawnee Nicole Paxton was traveling on her bicycle, with the front light on, and attempting to cross MacCorkle Avenue in South Charleston when Workman crashed his vehicle into her and killed her. 

Shawnna Paxton alleges Workman negligently drove his vehicle at a high rate of speed, was distracted and failed to take evasive actions to avoid an accident.

Paxton seeks trial by jury, compensatory, punitive and specific damages, attorney fees, costs, pre- and post judgment interest and all other necessary and proper relief.
