Kanawha County property buyers accuse seller of fraudulent representation

CHARLESTON — Two Kanawha County property buyers are suing a seller, alleging fraudulent misrepresentation.

Kevin Kemerer and Deona L. Kemerer filed a complaint in Kanawha Circuit Court against Bennie B. Ross Jr.,  alleging the defendant made material misrepresentations and made the plaintiffs believe that he owned the Charleston property in question.

According to the complaint, as a result of Ross' fraudulent actions, the Kemerers suffered damages of $12,000. The plaintiffs allege Ross held himself as the owner of a 165-acre tract of land and several buildings and its contents at 2076 Poca River Road, Charleston, to induce the plaintiffs to buy the property.

The suit says Ross did not own all of the land.

The Kemerers seek trial by jury and punitive damages of $24,000. They are representing themselves.
