Supplier alleges mining company owes $15,000

BECKLEY — A supplier is suing a mining company, alleging breach of contract.

Raleigh Mine and Industrial Supply Inc. filed a complaint April 10 in Raleigh Circuit Court against Brooks Run Mining Company LLC, alleging the defendant has invoices due and owing of more than $15,000.

According to the complaint, in December 2017, Raleigh Mine and Industrial Supply established an open account vendor relationship with Brooks Run, agreeing to terms by which the plaintiff would provide mining supplies on credit terms. Raleigh Mine says it has provided mining supplies on the open account but Brooks Run has accumulated unpaid and past invoices of $15,307.53. 

The plaintiff alleges Brooks Run Mining has failed to comply with the agreed contract to pay invoices in the amount of $15,307.53 for the mining supplies requested.

Raleigh Mine and Industrial Supply seeks trial by jury, judgment for unpaid payment of $15,307.53, plus pre-and post-judgment interest, costs, attorney fees, and allfurther relief the Court deems just and proper.
