Motorist in crash alleges insurer breached contract

BECKLEY — A Raleigh County man is suing a licensed insurer, alleging breach of an insurance contract.

Leonard G. Sims II filed a complaint April 5 in Raleigh Circuit Court against Erie Insurance Property & Casualty Company, alleging the defendant has failed to settle claims for damages the plaintiff sustained in a vehicle crash. 

According to the complaint, on May 4, 2016, Sims suffered injuries to his body when he was rear-ended on Ritter Drive in Glen Morgan by a car driven by Connor Bowen, an underinsured motorist. 

At the time of the accident, the suit says Sims was insured under the policy issued by Erie. The plaintiff alleges Erie Insurance Property & Casualty has failed to settle Sims' claim for damages.

Sims seeks trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees, court costs, expenses and all other just and appropriate relief. He is represented by attorneys Robert D. Cline Jr. and Brian E. Bigelow of Farmer, Cline & Campbell PLLC in Beckley.
