Visitor alleges Cross Lanes apartment complex's negligence caused fall

CHARLESTON — A Kanawha County man is suing Cross Lanes apartment complex operators, alleging insufficient measures were taken to prevent injuries.

Russell Anderson filed a complaint in Kanawha Circuit Court against Shamrock Villa Apartments LLC and John Doe, alleging failure to exercise reasonable care to protect invitees from injury.

According to the complaint, on Aug. 1, 2014, Anderson was injured at the defendants' apartment complex in Cross Lanes when he slipped and fell on wet, slick stairs. Anderson says he suffered injuries to his shoulder, head, neck, back, hips and legs. 

The plaintiff alleges the defendants failed to conduct a reasonable inspection to discover the hazardous condition and failed to eliminate the danger or warn invitees of the danger.

Anderson seeks trial by jury, compensatory damages, pre- and post-judgment interest, legal fees and court costs. He is represented by attorneys Scott G. Stapleton and Matthew P. Stapleton of Stapleton Law Offices in Huntington.
