Putnam Co. man accuses auto dealer of selling defective vehicle

CHARLESTON — A Putnam County man is suing automobile dealers, alleging breach of implied and express warranties.

William J. Jarrell filed a complaint in Kanawha Circuit Court against FCA US LLC, Transportation Network LLC, doing business as Walker Chrysler Dodge Jeep Ram, alleging failure to comply with the Magnuson-Moss Warranty Act.

According to the complaint, on Aug. 3, 2016, Jarrell purchased a new 2016 Dodge Dart SXT for personal use. After purchase, Jarrell said he experienced repeated nonconformities wth the vehicle that substantially impaired its use, value and safety. The suit says Jarrell has suffered monetary loss, mental distress, annoyance and inconvenience. 

The plaintiff alleges despite numerous attempts to repair the vehicle, the defendants have failed to conform the vehicle to the manufacturer's express warranties and refused to provide a comparable replacement.

Jarrell seeks trial by jury, cancellation of the sales contract, all damages, attorney fees, costs, pre- and post-judgment interest and all other general and appropriate relief. He is represented by attorney Charles M. Love IV of The Love Law Firm PLLC in Charleston.
