Former employee accuses Kanawha County business of wrongful termination

CHARLESTON — A Raleigh County woman is suing her former employer, alleging age discrimination and intentional infliction of emotional distress.

Linda Lilly of Coal Ridge filed a complaint in Kanawha Circuit Court against HCSG East LLC and Jonathan Fox , alleging violation of the West Virginia Human Rights Act.

According to the complaint, since 2000 Lilly had been employed as a housekeeper at the defendant's nursing home in Daniels until she was terminated Dec. 15, 2017. Lilly, who is older than 65, says during her employment, she was subjected to age discrimination by her co-workers that unreasonably interfered with her work performance and that the defendants tolerated discrimination perpetrated against her. 

As a result, Lilly says, she was intimidated, causing her severe mental anguish and emotional distress.The plaintiff alleges HCSG East and Fox continued to subject an employee to discrimination based on age, resulting in Lilly's wrongful termination.

Lilly seeks trial by jury, damages be determined by a jury, punitive damages, back pay, front pay, payment for lost benefits, attorney fees and all other just and proper relief. She is represented by attorney John Einreinhofer of Law Offices of John Einreinhofer in Charleston.
