Motorist, passenger allege another driver's negligence caused crash

LOGAN — A motorist and her passenger are suing State Farm and a vehicle driver, alleging unfair trade practices.

Cynthia Bryant and Paige Gore of Logan County filed a complaint April 18 in Logan Circuit Court against State Farm Mutual Automobile Insurance Company and Devin Ramon Fuller, alleging violation of the West Virginia Code. .

According to the complaint, on Dec. 22, 2016, Bryant was driving her 2007 Chevrolet Silverado northbound on U.S. Route 119 with Gore as her passenger. The suit says their Chevy was rammed into by a motor vehicle due to the carelessness Fuller, an uninsured driver. 

Bryant and Gore say they suffered injuries and damages, for which they made a claim for under-insured motorist benefits under the policy issued by State Farm. 

The plaintiffs allege State Farm has failed and refuses to pay the full amount of uninsured motorists benefits owed the plaintiffs.

Bryant and Gore seek trial by jury, all damages and legal fees, pre-judgment and post-judgment interest and all other proper and just relief. They are represented by attorney Robert Kuenzel of Kuenzel Law PLLC in Chapmanville.
