State seeks to enjoin J&J Auto Salvage from doing business in state until it obtains workers' comp coverage

CHARLESTON – The state is seeking an injunction against an employer over allegations it failed to obtain workers' compensation coverage for its employees.

State of West Virginia, ex rel. West Virginia Offices of the Insurance Commissioner, filed a complaint April 23 in Kanawha Circuit Court against J&J Auto Salvage Inc. and Wendy Spencer, in her individual capacity and as president of J&J Auto Salvage Inc., seeking an injunction.

According to the complaint, the defendants, as an employer, are required to maintain their own workers' compensation insurance coverage. The plaintiff alleges the defendants have failed to obtain and/or maintain coverage in violation of state law and are subject to various fines and penalties.

The plaintiff seeks to enjoin the defendants from doing business in the state until either they have obtained valid workers' compensation coverage as required by law and provide proof of coverage or satisfy that that have ceased working with employees in the state. It is represented by David Ansell of Legal Services Division in Charleston. The case has been assigned to Circuit Judge Charles E. King.
