CSX worker blames knee injury on unsafe work environment

HUNTINGTON — An Ashland, Kentucky, utility worker is suing a railroad corporation, alleging negligence.

Teresa Suzanne Hamm filed a complaint April 26 in Cabell Circuit Court against CSX Transportation Inc. for allegedly violating the Federal Employer's Liability Act by failing to provide employees a reasonably safe place to work.

According to the complaint, the plaintiff alleges that on Nov. 6, 2015 she suffered severe and permanent injuries to her left knee while working for the defendant at its Huntington Wheel Shop. She alleges she encountered multiple 4,000-pound wheels that had been chocked too lightly, causing her to have to manually roll each set of wheels up an incline to remove the chocks. 

As a result, Hamm claims she sustained physical pain, discomfort, mental anguish and medical expenses. 

The plaintiff holds CSX Transportation responsible because the defendant allegedly failed to provide proper equipment to permit employees to safely perform their work duties and failed to maintain work areas in a safe condition.

The plaintiff requests a trial by jury; and seeks judgment in an amount that will fully and fairly compensate her for her injuries and damages, together with post-judgment interest, costs and such other relief as the court may deem appropriate.
