Couple alleges homeowners association failed to maintain disposal pipeline

KEYSER — A Mineral County couple is suing a homeowners association, alleging insufficient measures were taken to prevent damages to their home.

Jason Miller and Myriah Miller filed a complaint in Mineral Circuit Court against Fountainhead Homeowners Association Inc.,  alleging failure to remediate a sewage pipeline problem.

According to the complaint, on July 6, 2017, the Millers discovered their basement was flooded, causing them to suffer property damage and emotional distress. 

The plaintiffs allege Fountainhead Homeowners Association, despite having knowledge of similar damage that occurred to other members, failed to properly maintain and operate the main disposal pipeline for sewage disposal.

The Millers seek trial by jury, actual and punitive damages, pre- and post-judgment interest and all other just and proper relief. They are represented by attorneys H. Orrin Staggers III and Harley O. Staggers Jr. of Staggers & Staggers in Keyser.
