WHEELING — A default judgment in excess of $150,000 has been filed against Wheeling attorney Robert Gaudio and the R.J. Gaudio Law Office in the Circuit Court of Shelby County, Alabama.
A recent filing in Ohio Circuit Court said Daniels Capital Corp. sued Gaudio and the firm in the Alabama court in 2011. The Alabama court entered a default judgment against Gaudio and the law office on Jan. 18.
The request to file foreign judgment was filed in Ohio Circuit Court in accordance with the Uniform Enforcement of Foreign Judgment Act.

The total amount of the judgment is $158,938.17. This amount includes a $158,466.17 actual judgment and $472 in prior court costs.
In a Nov. 9, 2012 order filed in the Alabama lawsuit, Shelby County Circuit Judge Hewitt L. Conwill ordered that Gaudio and his law office pay the judgment amount under the Alabama Rules of Civil Procedure.

Daniels advances 75 percent of an attorney's claim immediately and then pays the balance, minus its fee, once it has received the payment from the state or federal government.
Gaudio is a criminal defense attorney. He works with Public Defenders Corp. of the 1st Judicial Circuit. He was admitted to practice law in West Virginia in April 1997 and Ohio in 2005. His status is currently active, according to the West Virginia Bar Association.
