Property owners claim Wiseman Construction damaged property, breached lease

CHARLESTON — A pair of property owners are suing former tenant Wiseman Construction Co. Inc., for an alleged breach of a lease agreement.

James O. Garnes and Carolyn G. Garnes filed a complaint April 27 in Kanawha Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, in 2017 the Garnes suffered damages to their property in excess of $33,000 as a result of the defendant's allegedly improper removal of a pole building from the premises without the plaintiffs' consent.

The plaintiffs said they hold Wiseman Construction responsible for the damage because it allegedly failed to completely and properly restore a floor on the premises and because it removed a structure from the premises without the agreement or consent of the plaintiffs.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount of not less than $33,000, plus interest, attorney's fees and court costs. They are represented by John E. Dorsey of John E. Dorsey Law Firm in Charleston.
