Former KC Transport employee seeks payment of overtime wages

LOGAN — A former employee is suing trucking service provider KC Transport Inc. for allegedly unpaid overtime wages.

Thomas McComas filed a complaint May 1 in Logan Circuit Court, alleging that KC Transport violated the West Virginia Wage Payment and Collection Act and the Minimum Wage and Maximum Standards for Employees.

According to the complaint, in the course of McComas's employment, he regularly worked more than 40 hours per week without receiving proper overtime compensation.

The plaintiff claimed the defendant failed to pay overtime wages at one and a half times his regular rate for all overtime hours he worked and refused to pay wages in a timely manner.

The plaintiff requests a trial by jury and seeks payment for overtime wages due, liquidated damages, attorney's fees and other just and equitable relief. He is represented by Samuel B. Petsonk of Mountain State Justice Inc. in Beckley.
