Drilling contractor seeks payment from Kanawha Falls Public Service District

CHARLESTON — A drilling contractor is suing Kanawha Falls Public Service District and its board for breach of a water line replacement contract.

Precise Boring of Ohio LLC filed a complaint May 1 in U.S. District Court for the Southern District of West Virginia Charleston Division.

According to the complaint, on Aug. 1, 2017, the parties entered into a contract for the construction of a water line crossing replacement. The plaintiff claimed $139,544 remained due and payable on the contract as of May 1.

Precise Boring said the district has not paid the amount due, despite a request for payment.

The plaintiff requests a trial by jury and seeks a judgment against the defendants in the amount of $139,544, plus pre-judgment and post-judgment interest, costs, fees and expenses and such other damages deemed appropriate. It is represented by John F. Hussell IV of Wooton, Davis, Hussell & Ellis PLLC in Charleston.
