Marshall University faculty member claims school denied contracted fees

CHARLESTON — A Putnam County resident and Marshall University faculty member filed a lawsuit May 1 alleging that the university and some of its employees are guilty of breach of contract, sexual discrimination and unjust enrichment.

Sharon Mosko Rotenberry filed a complaint in Kanawha Circuit Court against Marshall University Research Corp., Marshall University, John Mahler, Mike Prewitt and Joe Cicarello for alleged violation of the Wage Payment Collection Act by denying payment of consulting fees allegedly owed to the plaintiff.

According to the complaint, Rotenberry joined the faculty at Marshall in January 2014 and relied on the defendants' representation that she would be permitted to earn and keep payments for professional consulting work. 

The plaintiff claims she fully performed her obligation under her contract of employment but was allegedly denied consulting payments amounting to $12,000. Rotenberry alleged that consulting payments exceeding 25 percent of her base salary were granted to her male counterparts. 

The plaintiff alleges that the defendants induced her to enter the employment contract and deliver valuable professional services but did not provide supplemental income at the levels she expected or required.

The plaintiff requests a trial by jury and seeks damages and lost wages , attorney's fees, costs and all other damages available under law. She is represented by Robert P. Lorea of Lorea Law Office PLLC in Charleston and Todd S. Bailess and Mike Addair of Bailes Smith PLLC in Charleston.
