Wayne motorist alleges negligent oil and gas driver caused crash

WAYNE — A Wayne motorist is suing a driver and her employer, alleging insufficient measures were taken to prevent injuries on the road.

Carl Smith filed a complaint May 4 in Wayne Circuit Court against Everetts Justice Jr. and Cabot Oil & Gas Corporation, alleging Justice negligently operated the vehicle owned by Cabot Oil, causing it to strike the plaintiff's vehicle.

According to the complaint, on Sept. 12, 2017, when Smith was driving his Hyundai on state Route 152 N.and Commercial Drive in Wayne, his vehicle was struck by a Ford F550 driven by Justice and owned by Cabot Oil. 

Smith says he sustained severe bodily injuries, pain and suffering, mental anguish, lost wages and inconvenience. The plaintiff alleges Justice negligently operated the vehicle while distracted and failed to maintain a safe speed and proper distance from Smith's vehicle.

Smith seeks trial by jury, judgment, jointly and severally, for all damages sustained by the plaintiff, pre- and post-judgment interest, attorney fees, court costs and all other appropriate relief. He is represented by attorney William T. Watson of Huntington.
