Kanawha Co. woman accuses GM of deceptive business practices

CHARLESTON — A Kanawha County customer is suing General Motors, alleging breach of implied and express warranties.

Amy Lemaster McMillion filed a complaint May 9 in Kanawha Circuit Court against General Motors LLC and Moses Chevrolet, alleging violation of the Magnuson-Moss Warranty Act.

According to the complaint, on July 22, 2017, McMillion purchased a 2017 Chevrolet Malibu from Moses Chevrolet. After purchase, McMillion says she experienced repeated non-conformities with the Malibu that substantially impaired its use, value and safety. 

She says she suffered monetary losses, emotional and mental distress, loss of use of the vehicle and inconvenience. The plaintiff alleges General Motors and Moses Chevrolet failed to provide a motor vehicle that conforms to the manufacturer's warranties and failed to make the repairs necessary to conform the vehicle to these warranties.

McMillion seeks trial by jury, cancellation of the sales contract by rejection, rescission or revocation of acceptance, all additional damages, attorney fees, costs and all other appropriate relief. She is represented by attorneys Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston.
