MOUNDSVILLE — A couple is suing an insurer, alleging bad faith and unfair trade practices.
Manuela M. Ross and David A. Ross filed a complaint in Marshall Circuit Court against Erie Insurance Property & Casualty Company alleging that the insurer failed to cover all damages stemming from a vehicle crash.
According to the complaint, on Sept. 15, 2014, Kevin Strope drove into the Ross' 2013 Dodge Journey while it was sitting in front of Cameron High school. The suit says the Rosses incurred medical expenses, suffered aggravation, inconvenience, emotional distress, mental anguish, depression, embarrassment, grief, loss of income and other compensatory damages.
The lawsuit alleges these problems resulted from the unlawful conduct of Erie Insurance in delaying payment of the plaintiffs' insurance claim without conducting a timely investigation, resulting from an accident due to the negligence of an underinsured/uninsured motorist.
The plaintiffs allege Erie Insurance Property & Casualty failed to implement standards for the prompt investigation of the Rosses' claim under the insurance policy, and delayed payment of their claim.
Manuela Ross and David Ross seek trial by jury, compensatory and punitive damages, attorney fees, litigation expenses, interest, court costs and all other appropriate relief. They are represented by attorney Ronald Wm Kasserman of Kasserman Law Offices PLLC in Wheeling.
