Kanawha County couple accuses air transportation company of fraud

CHARLESTON — A Kanawha County couple is suing an air transportation company, alleging breach of contract and fraud.

Jessica and Scott Ayres, and as natural parents and guardians of Addison Ayres, filed a complaint in Kanawha Circuit Court against Aitheras Aviation Group LLC alleging overcharging for the transportation of their daughter. 

According to the complaint, on March 20, Jessica and Scott Ayres sustained emotional distress, mental anguish, annoyance and inconvenience as a result of the fraudulent conduct of the defendant . The suit says Aitheras Aviation billed the plaintiffs $195,320, nearly 10 times the amount of $20,000 that had previously been agreed upon to transport their daughter via air ambulance to another medical facility. 

The plaintiffs allege Aitheras Aviation caused them to rely on its false representation about the costs of air ambulance services to induce them to enter into an agreement. .

Jessica and Scott Ayres seek trial by jury, compensatory damages, interest, costs of litigation, attorney fees and all further relief the court deems just. They are represented by attorneys Mark A. Colantonio and Robert J. Fitzsimmons of Fitzsimmons Law Firm PLLC in Wheeling.
