Man alleges Broadmore Senior Living at Teays Valley failed to prevent mother's falls

WINFIELD – The son of a woman who resided at a Hurricane nursing facility alleges the facility's negligence contributed to her falling numerous times.

John Eric Smith, administrator of the estate of Virginia Smith, deceased filed a complaint in Putnam Circuit Court against Broadmore Senior Living at Teays Valley and SSA Teays Valley ALF LLC alleging negligence.

According to the complaint, the plaintiff alleges that between Dec. 29, 2016, and March 30, 2017, Virginia Smith was a resident at defendants' nursing home facility where she suffered multiple falls. The suit states she sustained injuries, including lacerations to her back and head and left femoral neck transverse fracture because of the defendants' alleged negligence. 

The plaintiff holds Broadmore Senior Living at Teays Valley and SSA Teays Valley ALF LLC responsible because the defendants allegedly failed to provide adequate supervision and assistance to prevent Virginia Smith from falling.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, for all damages, attorney's fees, costs and all other issues triable by jury. He is represented by Karen S. Hatfield of Law Office of Karen S. Hatfield PLLC in Gilbert and Lela Walker of Lela Walker, Attorney at Law PLLC in Oceana.

The case has been assigned to Circuit Judge Joseph Reeder.
