Siblings accuse City National Bank officers of negligence

CHARLESTON — Two siblings are suing bank officers, alleging breach of fiduciary duty, intentional tort, slander, intentional and negligent infliction of emotional distress and negligence.

KR Petry and Terry Petry Boggess filed a complaint in Kanawha Circuit Court against City National Bank, Charles R. Hageboek et al., alleging they failed to conduct adequate investigation after receiving a sensitive information.

According to the complaint, KR Petry has suffered financial injury from a damaged reputation, lowered credit rating, bounced checks, unpaid bills and inconvenience. The suit blames the unlawful conduct of the defendants to freeze Petry's bank account after allegedly receiving a call of his death, while his co-plaintiff and sister suffered emotional distress, frustration and outrage from the treatment her brother received from the defendants. 

The plaintiffs allege the defendants failed to confirm facts or investigate the matter before taking drastic action, failed to return the plaintiffs' numerous calls or rectify their error that Petry was dead, and caused Petry detriment of his financial reputation.

Petry and Boggess seek trial by jury, general and punitive damages, plus all other just relief. They are represented by attorney Barbara Harmon-Schamberger in Ivydale.
