Supplier alleges debtor, guarantor owe more than $5,000

HUNTINGTON — A New Jersey supplier is suing a debtor and guarantor, alleging it owes more than $5,000 for breach of an agreement.

American Builders & Constructions Supply Company Inc., doing business as ABC Supply Co. Inc., filed a complaint in Cabell Circuit Court against Hersberger Holdings Inc., doing business as Heritage Contractors, and Paul Hersberger, alleging failure to perform their obligations under terms of the contract.

According to the complaint, on May 27, 2016, ABC Supply provided goods and services to defendants on an open account. As a result of of the defendants' actions, the plaintiff says it has been financially damaged in the amount of $5,363.72. 

The plaintiffs alleges Heritage Contractors and Hersberger have failed and refused to pay the remaining balance.

ABC Supply seeks trial by jury, judgment of $5,363.72, plus accrued interest of $224.30 and accruing interest from Dec. 9, 2017, court costs, attorney fees and all other proper relief. He is represented by attorneys James P. Tomasik of Reisenfeld & Associates LLC in Cincinnati.
