Bluefield property owner accuses lender of fraud

PRINCETON — A Bluefield resident is suing a home loan lender, alleging fraud and negligent misrepresentation.

Sarah Price filed a complaint in Mercer Circuit Court against PennyMac Loan Services LLC, alleging the defendant failed to offer any foreclosure alternatives to Price prior to instituting foreclosure proceedings.

According to the complaint, Price says she complied with every request from PennyMac and yet it still failed to send her the proper loss mitigation application, thereby denying Price the ability to save her home from foreclosure and retain her investment in the home. 

Price says she would not have faced foreclosure had PennyMac been allowed to process her requests for appropriate loss mitigation. 

The plaintiff alleges PennyMac Loan Services accepted and reviewed her financial status before refusing to review her for a loan modification and simultaneously referring the home to foreclosure.

Price seeks trial by jury, appropriate equitable relief, actual and punitive damages, attorney fees, costs of litigation, and all other equitable and just relief. She is represented by attorneys Jed R. Nolan, Sarah K. Brown and Bren J. Pomponio of Mountain State Justice Inc. in Beckley.
