Vehicle owner accuses State Farm, towing service of negligence

CHARLESTON — A Kanawha County motor vehicle owner is suing State Farm and a towing service, alleging breach of contract and negligence.

Todd Lepley filed a complaint in Kanawha Circuit Court against the State Farm Mutual Automobile Insurance Company and John Doe, alleging State Farm failed to deal with Lepley's claim fairly, in good faith and in a timely manner.

According to the complaint, on June 24, 2016, Lepley's vehicles were damaged by a flood. As a result of the defendants' actions, the suit says, the vehicles sustained additional damages. 

The plaintiff alleges State Farm refused and continues to refuse to pay additional damages for Lepley's vehicles and Doe negligently towed one vehicle, causing additional damages.

Lepley seeks trial by jury, compensatory and punitive damages, court costs and expenses, attorney fees and all other just and proper relief. He is represented by attorney Michael J. Del Giudice of Ciccarello Del Giudice & Lafon in Charleston.
