Couple claims Thornhill Superstore misrepresented value of vehicle

LOGAN – A Chapmanville auto dealer is alleged to have misrepresented the value of a vehicle to a Davin couple and charged illegal and improper fees.

Howard B. Belcher and Barbara J. Belcher filed a complaint in Logan Circuit Court against Thornhill Superstore Inc. alleging fraud, improper fees and charges and other counts.

According to the complaint, the plaintiffs allege that on April 2017, they purchased a 2011 Toyota Scion from defendant for $14,600. They allege they later learned from another dealership said the vehicle was worth $6,000 to $8,000. 

The plaintiffs also claim they were charged fees by the defendant that were not reasonable.

The plaintiffs hold Thornhill Superstore Inc. responsible because the defendant allegedly intentionally misrepresented the true market value of the vehicle.

The plaintiffs request a trial by jury and seek actual damages, attorney's fees, costs and such other appropriate and equitable relief. They are represented by Sarah K. Brown and Gary Smith of Mountain State Justice Inc. in Charleston.

The case has been assigned to Circuit Judge Joshua Butcher.
