Son files wrongful death suit against Mercer Nursing and Rehabilitation Center

PRINCETON – A Princeton man alleges a Bluefield nursing home's negligence contributed to his mother's death.

David C. Ruble, as personal representative of the estate of Norma L. Ruble, filed a complaint in Mercer Circuit Court against Mercer Nursing and Rehabilitation Center, Wisteria LLC and AMFM LLC alleging negligence, wrongful death and other counts.

According to the complaint, David C. Ruble alleges that on July 7, 2017, his mother, Norma L. Ruble was admitted to defendants' Mercer Nursing and Rehabilitation Center for rehabilitation and assistance with her activities of daily living. 

However, he alleges the defendant failed to provide his mother a safe environment and sufficient food and fluid intake.

The plaintiff holds Mercer Nursing and Rehabilitation Center, Wisteria LLC and AMFM LLC responsible because the defendants' alleged negligence caused injuries to Norma Ruble that leaded or contributed to her death on July 12, 2017.

The plaintiff requests a trial by jury and seeks all damages allowable under West Virginia law, attorney's fees, punitive damages as well as any other items and relief that the court sees fit to award. He is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.

The case has been assigned to Circuit Judge Derek C. Swope.
