Food trailer owner alleges she was dismissed from West Union plant after rejecting sexual advances

CLARKSBURG – A food service trailer owner alleges she was removed from a plant site after rejecting a manager's sexual advances.

Tammy Porter filed a complaint in the Harrison Circuit Court against M.W. Logistics Services LLC alleging that the Colorado corporation violated the West Virginia Human Rights Act. It later was removed to federal court.

According to the complaint, the plaintiff alleges that between February 2017 and Jan. 24, she operated a food service trailer and vending machine at the Sherwood Processing Plant in West Union. She alleges her business was shut down and removed from the site 10 days after she rebuffed the unwelcome sexual advances of the plant manager.

The plaintiff holds M.W. Logistics Services LLC responsible because she allegedly has suffered damages as a result of the plant manager's allegedly illegal decision to terminate her from the site.

The plaintiff requests a trial by jury and seeks judgment in her favor to fully compensate her for her losses. She is represented by David E. Goddard and Edmund L. Wagoner of Goddard & Wagoner PLLC in Clarksburg.

The case was removed to the U.S. District Court for the Northern District of West Virginia at Clarksburg on May 25 by the defendant.
