Don Ward Contracting alleged to have violated building codes with construction on home

BECKLEY – Two property owners allege that a Raleigh County contractor performed work on their home that is in violation of local building codes.

Benny Warden and Kristie Warden filed a complaint in Raleigh Circuit Court against Don Ward Contracting alleging breach of contract.

According to the complaint, the plaintiffs allege that on Dec. 8, 2016, the parties entered into a contract for work on plaintiffs' home in Beckley. The plaintiffs allege the work performed by the defendant is substandard and in violation of local building codes.

The plaintiffs hold Don Ward Contracting responsible because the defendant allegedly failed to perform all work in workmanlike manner and despite the opportunity to cure the defects, the defendant failed to respond.

The plaintiffs seek judgment against the defendant in an amount based on evidence. They are represented by Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville.

The case has been assigned to Circuit Judge Robert A. Burnside Jr.
