Passenger in Rent-a-Car vehicle seeks damages from driver after I-64 collision

CHARLESTON – A Charleston woman alleges she was injured in a collision with a tractor-trailer.

Megan Brooke McCormick filed a complaint in Kanawha Circuit Court against Erica D. McCormick and EAN Holdings LLC, formerly known as Enterprise Rent-A-Car Co. of Kentucky, alleging negligence.

According to the complaint, on Aug. 6, 2007, Megan Brooke McCormick was a passenger on a Rent-a-Car vehicle from defendant EAN Holdings and driven by defendant Erica McCormick. The plaintiff alleges she was injured when Erica McCormick stuck the rear-end of a tractor-trailer on Interstate 64 in Cross Lanes.

The plaintiff holds the defendants responsible because defendant Erica D. McCormick allegedly failed to maintain control of the vehicle, failed to keep a proper lookout, failed to exercise due care to avoid colliding with any vehicle upon any roadway.

The plaintiff requests a trial by jury and seeks judgment for compensatory damages, pre- and post-judgment interest, attorneys' fees, costs incurred and all other and further relief deemed just and proper under the law. She is represented by Troy N. Giatras of The Giatras Law Firm, PLLC in Charleston.

The case has been assigned to Circuit Judge Charles E. King.
