Driver alleges Fleet Service van malfunction while traveling, caused accident

MOUNDSVILLE – An Ohio County man alleges he was injured while working because of the defective nature of a van.

Michael McCabe filed a complaint in Marshall Circuit Court against Fleet Service Co. Inc. alleging that liability.

According to the complaint, the plaintiff alleges that on May 31, 2016, he was operating defendant's 1998 Ford Econoline Van on Route 250 in Cameron when it suddenly malfunctioned and broke, causing to swerve and flip on its side. He alleges the incident caused him permanent injuries to his head, neck, back, elbow, shoulders and other parts of the body. 

The plaintiff holds Fleet Service Co. Inc. responsible because the defendant allegedly breached its duty of due and reasonable care to the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of the minimum jurisdictional limits of the court, with interest, costs and all other relief as the court may find proper and just. He is represented by Jacob M. Robinson of Robinson Law Offices in Wheeling.

The case has been assigned to Circuit Judge David W. Hummel Jr.
