Consumer alleges Global Investment Group is wrongfully refusing to return payments

HUNTINGTON – A consumer alleges she requested a return of payments she made on a layaway agreement for a vehicle and that the seller has refused to return the money.

Valerie Garrett-Reyes filed a complaint in Cabell Circuit Court against Global Investment Group LLC, doing business as Route 60 Used Cars, alleging unjust enrichment.

According to the complaint, the plaintiff alleges that on March 19, she entered into a contract with defendant to purchase a 2006 Toyota Rav 4 automobile for $5,800 on an oral, layaway agreement. The suit states that after paying $2,400 towards the purchase of the vehicle, she became unemployed, rendering her unable to continue making payments. She alleges she requested the return of the $2,400 paid and the defendant refused to return it, stating that the payments were forfeited.

The plaintiff alleges the defendant is barred by the statute of frauds from seeking a forfeiture of the payments.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of the jurisdictional limits of the court and such other and further relief as the court deems just. She is represented by J. William St. Clair of Legal Aid of West Virginia in Huntington.

The case has been assigned to Circuit Judge Alfred E. Ferguson.
