Grocery wholesaler alleges diner owes more than $28,000

HUNTINGTON — A Huntington grocery wholesaler is suing a Whitesville diner, alleging it owes more than $28,0000 for breach of agreement and unjust enrichment.

Goldsmit Sydnor Inc. filed a complaint in Cabell Circuit Court against Route 3 Company Store and Diner LLC and Charles D. Burdette, alleging they violated the terms of their agreement.

According to the complaint, on June 30, 2015, Route 3 Company Store and Diner and Burdette signed and submitted a credit an application to plaintiff for consideration of commercial credit. Over time, the suit says, the defendants' account with the plaintiff fell into arrears. 

Currently, the defendants' account allegedly is delinquent in the amount of $28,517.91. The plaintiff alleges the defendants have failed to make payments for these proper amounts.

Goldsmit Syndor seeks trial by jury, judgment of $28,517.91, plus costs, attorney fees, pre- and post-judgment interest and all other just and proper relief. He is represented by attorneys Arnold J. Janicker and Steven P. Turner of Jenkins Fenstermaker PLLC in Huntington.
