Mine superintendent alleges wrongful termination

LOGAN — A mine superintendent is suing his former employers, alleging age discrimination and wrongful termination.

Carlos Porter filed a complaint in Logan Circuit Court against Arch Coal Inc., Mingo Logan Coal LLC, J. Chris Sykes and Pam Tucker, alleging violation of the West Virginia Human Rights Act.

According to the complaint, Porter, 64, despite working in a satisfactory manner for more than 20 years, was wrongfully discharged March 10, 2017. The suit says he has suffered loss of his employment, lost wages and benefits, indignity, embarrassment, and inconvenience. 

The plaintiff alleges the defendants subjected him to disparate treatment on the basis of his age and disability and terminated his employment and replaced him with two younger employees.

Porter seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees, court costs and all other just relief. He is represented by attorneys Robert B. Warner and Kameron T. Miller of Warner Law Offices PLLC in Charleston.
