Customer alleges St. Albans theater owner's negligence caused injuries

CHARLESTON — A South Charleston woman is suing a St. Albans theater owner, alleging negligence caused injuries to the plaintiff.

Lonna F. Barker filed a complaint in Kanawha Circuit Court against St. Albans Business and Community Development Group Inc., alleging that the theater owner failed to keep its theater premises free from hazards.

According to the complaint, on June 10, 2016, Barker was inside the defendant's Alban Arts Center watching a performance. The suit says Barker attempted to leave during the performance. She says she followed the usher's direction and reached the end of the bleachers, which had no aisle lighting or any safety measures.

The lawsuit states Barker, 75, fell several feet to the stage floor. She says she suffered serious injuries to her body that required medical treatment and physical therapy. 

The plaintiff alleges St. Albans Business and Community Development Group failed to provide proper assistance, failed to place any lighting or illumination and failed to give any warning of the dangerous condition.

Barker seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees, costs and all other just relief. She is represented by attorney Brian L. Ooten of Shaffer & Shaffer PLLC in Madison.
