South Charleston building owner alleges hospital owes more than $30,000

CHARLESTON — A South Charleston commercial property landlord is suing a hospital tenant, alleging it owes more than $30,000 for breach of a lease agreement.

Haddad's Professional Building LLC filed a complaint in Kanawha Circuit Court against Herbert J. Thomas Memorial Hospital Association, alleging the tenant has failed to pay its rental obligations.

According to the complaint, on Nov. 14, 2008, Thomas Memorial agreed to lease Haddad's commercial building, at 4825 MacCorkle Ave. South Charleston. As of the date of filing of this complaint, the suit says, the defendant has failed to pay its rental obligations from May-July 2018 in the amount of $10,255.12 per month. 

The plaintiff alleges Herbert J. Thomas Memorial Hospital Association has failed to cure the default of its obligation under the terms of the lease agreement.

Haddad's Professional Building seeks trial by jury, judgment for the total unpaid rent of $30,765.36, plus interest, court costs and expenses, attorney fees and any just and fair relief. It is represented by attorney G. Thomas Smith of Smith McMunn & Glover PLLC in Clarksburg.
