Stewart Title Guaranty seeks reimbursement from United Title over alleged omissions on deed

CHARLESTON – A title insurance underwriter alleges it had to pay $85,000 to a mortgage company because of the negligence of an agent.

Stewart Title Guaranty Co. filed a complaint in Kanawha Circuit Court against United Title Co. alleging breach of agreement and negligence.

According to the complaint, the parties entered into a title insurance underwriting agreement in October 2017 that authorized the defendant to issue title insurance commitments and policies on the plaintiff's behalf.

The plaintiff alleges an insured deed of trust issued by the defendant omitted information and SunTrust Mortgage filed a claim of loss. The plaintiff alleges it made a payment of $85,000 to SunTrust Mortgage for the loss it incurred because of the omissions.

The plaintiff holds United Title Co. responsible because the defendant allegedly failed to reimburse it for the loss.

The plaintiff seeks reimbursement representing plaintiff's loss in the amount of $85,000, attorney's fees, costs and expenses and any further relief as the court deems just and proper. It is represented by Stephen L. Thompson of Barth & Thompson in Charleston.
