River City Roofing alleged to owe more than $40,000 for insurance policy

CHARLESTON – A Charleston insurance company alleges that a company failed to pay for its insurance policy.

BrickStreet Mutual Insurance Co. filed a complaint in Kanawha Circuit Court against River City Roofing LLC alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that between Feb. 3 and Aug. 1, 2017, the plaintiff provided defendant with workers' compensation and employer's liability insurance. To date, the premium in the amount of $48,910 allegedly remains due and owing. 

The plaintiff holds River City Roofing LLC responsible because the defendant allegedly breached the contract by failing to pay the premium owed under the policy.

The plaintiff requests a trial by jury and seeks judgment in its favor in the amount of $48,910, plus costs, attorney's fees, interest and such other just and proper relief. It is represented by Arnold J. Janicker and Steven P. Turner of Jenkins Fenstermaker PLLC in Huntington.

The case has been assigned to Circuit Judge Charles E. King.
