Woman in her 80s accuses Kanawha County restaurant of wrongful termination

CHARLESTON — A former employee is suing a Kanawha County restaurant and supervisor, alleging age discrimination and wrongful termination.

Iva Lou Burdette filed a complaint in Kanawha Circuit Court against Fire Mountain Restaurants LLC doing business as Ryan's Restaurant and Linda Bolingalleging they subjected her to adverse employment actions because of her age (early 80s).

According to the complaint, on June 19, 2016, Burdette was discharged after 11 years of employment at the Southridge restaurant. She says she has suffered lost wages and employment benefits, emotional distress, embarrassment and mental anguish. 

The plaintiff alleges Ryan's and Boling discriminated against Burdette and terminated her employment because of her age--81 at the time of her firing.

Burdette seeks trial by jury, back pay and employment benefits, reinstatement or front pay, compensatory damages, attorney fees, court costs and all further just and proper relief.
