Maryland contractor alleges business customer owes $38,000

KEYSER — A Maryland mechanical contractor is suing Mineral County business customers, alleging they owe more than $38,000 for breach of contract and unjust enrichment.

Walter N. Yoder & Sons Inc. filed a complaint in Mineral Circuit Court against Donald Hayes, Hayes Contractors Inc. and S&D Builders Inc., alleging failure to pay their indebtedness.

According to the complaint, Yoder & Sons provided materials and performed mechanical-related services for the defendants in the total amount of $24,690. To date, the suit says, no part of that amount has been paid and Yoder & Sons is entitled to interest of the debt in the amount of $13,612.29. 

The plaintiff alleges the defendants have failed to pay for materials and services provided by plaintiff.

Walter N. Yoder & Sons seeks trial by jury, judgment against the defendants, jointly and severally, of $38,302.29, plus costs of court and all other general relief. It is represented by attorney Nelson M. Michael of Keyser.
