Kanawha County business alleges customer owes nearly $29,000

CHARLESTON — A Kanawha County corporation is suing a Mercer County debtor and guarantor, alleging breach of contract and guaranty agreement in failing to pay.

Ferguson Enterprises Inc. filed a complaint in Kanawha Circuit Court against Southwest Mechanical Inc. and James E. Ross, alleging failure to perform their contractual obligations.

According to the complaint, on Dec. 31, 2006, Ferguson Enterprises agreed to sell materials and supplies to the defendants on credit. The plaintiff extended credit to Southwest Mechanical and Ross in the principal amount of $24,929.34, the suit says. 

The plaintiff alleges the defendants have failed and refused to make payments for materials and supplies provided.

Ferguson Enterprises seeks trial by jury, judgment against the defendants, jointly and severally, of at least $28,754.32, plus interest, service charges, attorney fees, costs and all other just and appropriate relief. It is represented by attorney Mary K. Prim of Scott Depot.
